Many municipal officials, lawmakers, and activists for New Yorkers experiencing homelessness and mental illness had asked for Mr. Penny’s arrest to be made immediately.

They claimed Mr. Neely’s death demonstrated the city’s failure to care for its most vulnerable and disenfranchised inhabitants.

The murder of Neely and the lack of prompt legal action provoked outrage and rallies across Manhattan, with many demanding Penny’s arrest.

Some public officials, including New York City Council Speaker Adrienne Adams, indicated that racism was a part of the homicide.

In contrast, others stated that the episode exposed the city’s inability to care for disadvantaged communities.

Where Is Daniel Penny Now?

Daniel Penny, the Marine veteran at the center of Jordan Neely’s choking murder on a subway train last week, is scheduled to surrender to authorities as soon as Friday to face criminal charges.

Neely, a homeless man, died on May 1 after Penny reportedly choked him for several minutes. According to witnesses, Neely was screaming at and abusing people on the train before being restrained and killed by Neely and others.

Neely’s death was deemed murder by the Medical Examiner’s office. Penny, 24, will face a charge of second-degree manslaughter, which carries a maximum sentence of 15 years in prison.

Following Neely’s murder, there have been many demonstrations around the city.

Consequently, at least 11 individuals have been detained, and the NYPD is looking for five demonstrators who reportedly stormed the Upper East Side subway rails last Saturday.
