Her father, William R. Scherer, is a private attorney renowned for advocating George W. Bush during the 2000 US presidential election.

Before becoming a judge in 2012, appointed by Governor Rick Scott, Scherer worked as a prosecutor under state attorney Michael Satz.

On April 13, 2023, the Florida Supreme Court granted death row inmate Randy Tundidor’s request to disqualify Scherer from his case.

The request was based on Elizabeth’s inappropriate actions following Cruz’s sentencing to life in prison.

In response to this incident, Scherer resigned from her position, with her resignation set to take effect on June 30, 2023.

On June 2, 2023, the Florida Judicial Qualifications Commission investigated and found that Scherer violated several judicial conduct rules during Cruz’s trial.

Scherer’s violations during Cruz’s trial included “unduly chastising” the public defender Melisa McNeill and her team.

Furthermore, she made baseless accusations against one of Cruz’s attorneys and inappropriately embraced prosecution team members after the trial’s conclusion.

The Commission recommended a public reprimand for Scherer, subsequently issued the following month.
